The fall sitting of the 3rd session of the 61st General Assembly of the Nova Scotia Legislature began on October 31, 2011 and rose on Thursday, December 15, 2011. 40 Government Bills, 27 Private Member’s Bills and 4 Private and Local Bills have been introduced during this sitting of the House of Assembly.
Below is a summary of those Bills introduced between December 12 and December 16, 2011 and a final update of the status of all bills introduced during the 3rd session of the 61st General Assembly.
GOVERNMENT BILLS
Bill No. 136 – Members’ Pension Review Implementation (2011) Act – Hon. Frank Corbett
This Bill will implement changes regarding MLA pension plans in Nova Scotia. The proposed changes came from the recommendations provided by the independent Pension Review Panel and some of the changes will take effect immediately whereas others will only take effect after the next general election. The MLA pension plan accrual rate will be reduced from five per cent per year for 15 years to three-and-one-half per cent per year for 20 years. This will reduce the current maximum pension accrual from 75 to 70 per cent. Legislative changes are being made to the Members’ Retiring Allowance Act to comply with Canada Revenue Agency requirements. The Minister of Finance will be named as the trustee of the MLA pension plan and the government, through the trustee, will look at creating an identifiable secured pool of assets as a separate fund for the MLA pension plan in the future. A MLA pensioner who is 65 years of age or more, in receipt of a monthly pension that is less than $1,000 per month and who has never divided or split his or her pension, will have their pension increased to $1,000 per month. Upon ceasing to be a Member of the House of Assembly, the former member will be eligible for a transition allowance in accordance with the following formula: person’s years of service as an MLA multiplied by 1/12 the annual MLA base salary. The allowance is to a maximum of one year’s MLA pay and a minimum of three months, unchanged from before. A former MLA will also now have access to retiring or career counseling services to a maximum value of $7,500. As a final note, the MLA pension plan will remain a defined benefit pension plan and the contribution rate will remain at 10 per cent of the annual salary.

PRIVATE MEMBER’S BILLS
Bill No. 135 – Workers’ Compensation Act (amended) – Hon. Michel P Samson (Lib)
This Bill will expand the definition of “worker” to include an auxiliary member of a municipal police department or RCMP detachment. This change will allow for the application of Part I of the Workers’ Compensation Act to the auxiliary members of a municipal police department or RCMP detachment upon application by the municipality that established the police department or within the boundaries of which the RCMP detachment is located and serves.

THE PROGRESS OF BILLS IN THE NOVA SCOTIA LEGISLATURE
The legislative process begins when a Bill is presented by a Member of the House of Assembly and is given First Reading by the House, without debate.
A Bill is given Second Reading after being debated in principle in the House.
Following Second Reading, Bills are referred to one of the legislative committees – the Law Amendments Committee or Private and Local Bills Committee – for detailed discussion in meetings outside the House. Members of the public can attend the meetings of these Committees and make presentations respecting any Bill. Amendments are frequently considered and may be adopted and included in the Bill when it is reported back to the House.
Bills reported back from the legislative committees are debated, clause by clause, by the members of the House acting as the Committee of the Whole House on Bills. The Bill is then reported back to the House.
The Bill receives Third Reading and the final approval of the House. There may be some debate at this stage but usually the Bill is voted on with no discussion.
The Bill receives Royal Assent when the Lieutenant Governor signs the final version. The Bill is then referred to as an Act, and is assigned a chapter number in the Statutes of Nova Scotia.
Commencement is the day on which the Act takes effect. Ordinarily, an Act takes effect when it is given Royal Assent. Sometimes, however, it provides that it will come into effect only when is it proclaimed to take effect by Order in Counsel to be made by the Cabinet.
Government Bills are introduced by the Minister of the department responsible for the legislation. Private Members Bills are generally introduced by a member of the opposition parties. Government Bills have a higher likelihood of becoming law since the largest party in the Legislative Assembly supports the initiative. Except in a minority government, Private Members Bills are unlikely to be brought forward for substantive debate or become law.
